Relying on legitimate interests as a lawful basis for processing personal data brings extra responsibility for protecting people's rights. This 10-minute express course covers the six legal bases for processing under the UK GDPR, explains what legitimate interests means, and shows how to conduct a legitimate interest assessment that documents the purpose, necessity and balancing test properly.
Legitimate interests is chosen because it looks flexible, then relied on without the assessment that makes it valid. An LIA produced after a complaint carries very little weight. Training the people who decide how data will be used means the assessment happens before processing starts, which is the only point at which it can influence the design.
